TERMS AND CONDITIONS

 

1. General Information

  1. These Terms and Conditions (“T&C”) govern the contractual relationship between:

    • and the Customer purchasing through noelgrave.com.

  2. The e-shop is operated via the Shoptet platform.

  3. The Seller offers digital products – e-books, delivered electronically only.

2. Applicable Law

  1. These T&C are governed by the laws of the Slovak Republic and the European Union.

  2. If the Customer is located outside the EU (including the USA), the contract shall still be governed by Slovak law, unless mandatory consumer laws of the Customer’s country apply.

3. Orders and Contract Formation

  1. By placing an order, the Customer confirms acceptance of these T&C.

  2. The contract is concluded upon order confirmation by the Seller.

  3. The Customer must provide accurate information, especially a valid email address.

4. Prices and Payment

  1. Prices are displayed in the selected currency (EUR or USD).

  2. Payment is made online via Shoptet-supported payment gateways.

  3. Access to the digital product is granted after successful payment.

5. Digital Delivery

  1. The e-book is delivered via:

    • download link sent to the Customer’s email, or

    • access in the Customer account.

  2. Delivery occurs without undue delay, no later than 24 hours after payment.

6. Right of Withdrawal

  1. The Customer acknowledges that no right of withdrawal applies once:

    • the supply of digital content has begun,

    • explicit consent was given,

    • the Customer was informed about the loss of the right of withdrawal.

  2. Consent is granted before completing the purchase.

7. Liability and Complaints

  1. The Seller warrants that the digital content matches its description.

  2. Complaints must be submitted via email.

  3. Complaints will be resolved within 30 days.

8. Copyright

  1. All e-books are protected by copyright.

  2. The Customer receives a non-exclusive, personal-use license only.

  3. Redistribution or resale is strictly prohibited.

9. Data Protection

  1. Personal data is processed in accordance with GDPR.

  2. Full details are provided in the Privacy Policy.

10. Dispute Resolution

  1. Any disputes shall be governed by Slovak law.

  2. EU consumers may use the EU Online Dispute Resolution platform.

11. Final Provisions

  1. These T&C are effective as of 20.1.2026

  2. The Seller reserves the right to amend these T&C.

The following checkbox texts are prepared for use in the Shoptet checkout when selling digital products (e-books). These texts are compliant with EU consumer law and GDPR requirements.

1. Consent to Immediate Delivery of Digital Content

2. Acknowledgement of Loss of Right of Withdrawal

☑ I acknowledge that by giving my consent to the immediate delivery of digital content, I lose my right to withdraw from the contract once the download or access has begun, in accordance with applicable consumer protection laws.

3. Acceptance of Terms and Conditions

1. Digital Products – No Refund Policy

All products sold on this website are digital products delivered electronically. Due to the nature of digital content, all sales are final and non-refundable. No refunds, exchanges, or cancellations are provided once access to the digital product has been granted, except where required by applicable law.

2. No Guarantees / No Professional Advice

The digital products are provided for informational and educational purposes only. The Seller makes no guarantees regarding specific results, outcomes, or earnings. Nothing contained in the digital products constitutes legal, financial, medical, or professional advice.

3. Limitation of Liability

To the maximum extent permitted by law, the Seller shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to the use or inability to use the digital products.

The Seller’s total liability for any claim shall not exceed the amount paid by the Customer for the specific digital product.

All digital products are protected by international copyright laws. Unauthorized copying, distribution, resale, or sharing of the digital products is strictly prohibited.

If you believe that your copyrighted work has been infringed, you may submit a DMCA takedown notice including the following information: - Identification of the copyrighted work - Identification of the infringing material - Your contact information - A statement of good-faith belief - A statement made under penalty of perjury

5. Governing Law

This Disclaimer shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to conflict of law principles.

1. Všeobecné ustanovenia

  1. Tieto obchodné podmienky („OP“) upravujú práva a povinnosti medzi:

    • a Kupujúcim, ktorý uskutoční nákup prostredníctvom e-shopu noelgrave.com.

  2. E-shop je prevádzkovaný na platforme Shoptet.

  3. Predmetom predaja sú digitálne produkty – e-booky, dodávané výhradne elektronicky.

2. Právne predpisy

  1. Tieto OP sú vypracované v súlade s právnymi predpismi SR a EÚ, najmä:

    • zákon č. 108/2024 Z. z. o ochrane spotrebiteľa,

    • zákon č. 40/1964 Zb. Občiansky zákonník,

    • nariadenie GDPR (EÚ) 2016/679.

  2. Ak je Kupujúci zo zahraničia (napr. USA), zmluvný vzťah sa riadí právnym poriadkom Slovenskej republiky, pokiaľ kogentné predpisy krajiny Kupujúceho neustanovujú inak.

3. Objednávka a uzatvorenie zmluvy

  1. Odoslaním objednávky Kupujúci potvrdzuje, že sa oboznámil s OP a súhlasí s nimi.

  2. Kúpna zmluva vzniká potvrdením objednávky Predávajúcim.

  3. Kupujúci je povinný uviesť pravdivé údaje, najmä e-mail potrebný na dodanie digitálneho obsahu.

4. Cena a platby

  1. Ceny sú uvedené:

    • bez DPH / s DPH podľa daňového režimu Predávajúceho,

    • v mene uvedenej v e-shope (EUR alebo USD).

  2. Platba prebieha online prostredníctvom platobnej brány Shoptet.

  3. Digitálny obsah je sprístupnený po úspešnej platbe.

5. Dodanie digitálneho obsahu

  1. E-book je dodaný:

    • zaslaním odkazu na stiahnutie na e-mail Kupujúceho alebo

    • sprístupnením v zákazníckom účte.

  2. Dodanie prebehne bez zbytočného odkladu, najneskôr do 24 hodín.

6. Odstúpenie od zmluvy

  1. Kupujúci – spotrebiteľ berie na vedomie, že nemá právo na odstúpenie od zmluvy, ak:

    • sa začalo s dodávaním digitálneho obsahu,

    • udelil výslovný súhlas so začatím dodávania,

    • bol poučený o strate práva na odstúpenie.

  2. Tento súhlas je udelený pred dokončením objednávky.

7. Reklamácie

  1. Predávajúci zodpovedá za to, že digitálny obsah je funkčný a zodpovedá popisu.

  2. Reklamáciu je možné uplatniť e-mailom.

  3. Reklamácia bude vybavená najneskôr do 30 dní.

8. Autorské práva

  1. E-book je chránený autorským právom.

  2. Kupujúci získava nevýhradnú licenciu na osobné použitie.

  3. Akékoľvek šírenie alebo ďalší predaj je zakázaný.

9. Ochrana osobných údajov

  1. Osobné údaje sú spracúvané v súlade s GDPR.

  2. Podrobnosti sú uvedené v dokumente Zásady ochrany osobných údajov.

10. Riešenie sporov

  1. Spory sa riešia podľa práva SR.

  2. Spotrebiteľ má právo obrátiť sa na Slovenskú obchodnú inšpekciu alebo ODR platformu EÚ.

11. Záverečné ustanovenia

  1. OP sú platné od 20.1.2026

Predávajúci si vyhradzuje právo OP meniť.
